§ 1 Scope and supplier
(1) These General Terms and Conditions apply to all contracts you conclude with us through this online shop:

We sell our products under the brand Pamir Fine Fibers.
(2) Differing terms apply only where we have expressly agreed them with you in writing. We object to the inclusion of the customer's own terms.
(3) A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is anyone acting in the exercise of their independent professional or commercial activity when concluding the transaction.
§ 2 Conclusion of the contract
(1) The subject of the contract is the sale of goods and of digital content, in particular knitting patterns in PDF format.
(2) The presentation of products in the online shop is not a binding offer, but a non-binding invitation for you to make an offer.
(3) You place the products you want in the shopping cart and can change it at any time. Once you have entered your details and your payment and delivery information, you are shown an order summary. Before submitting, you can check and correct all details or cancel the order.
(4) By submitting your order using the “Buy now” or “Place order” button, you make a binding offer to conclude a contract of sale.
(5) We confirm receipt of your order by email without delay. This acknowledgement of receipt does not yet constitute acceptance of your offer.
(6) The contract is concluded as soon as we accept your order. Acceptance takes place through a separate shipping or order confirmation, at the latest when the goods are handed over to the carrier. For digital content, the contract is concluded when the download link is made available. If we do not accept your order within five working days, you are no longer bound by your offer; in that case we refund any payments already made in full.
(7) If an ordered product is unavailable, we will inform you by email without delay and refund any payments already made for that product in full.
(8) Order processing is partly automated by email. Please make sure that the email address you provide is correct and that delivery is not blocked by spam filters.
§ 3 Prices and payment
(1) Prices are shown to you in Swiss francs or in euros, depending on the delivery country. The currency displayed during the order process is the one that applies. Prices are total prices including any value added tax. Shipping costs are not included; they are shown separately during the order process.
(2) The available payment methods are shown to you during the order process.
(3) With the immediate payment methods offered during the order process, the purchase price is collected when you submit your order. If no contract comes into effect, we refund the amount in full.
§ 4 Delivery, shipping and passing of risk
(1) Delivery is made to the delivery address you provide. We do not ship at weekends or on public holidays.
(2) Shipping costs, delivery times and any delivery restrictions are set out in our shipping policy.
(3) If you are a consumer, the risk of accidental loss and accidental deterioration passes to you only when the goods are handed over to you — regardless of whether the shipment is insured. This does not apply where you have independently engaged a carrier not named by us.
(4) If you are an entrepreneur, shipping is at your risk.
(5) Please check the shipment on receipt for completeness and transport damage and report any complaints as promptly as possible. Failure to make such a report has no effect on your statutory warranty rights.
§ 5 Digital content and rights of use
(1) We make digital content available to you within 24 hours of receiving your order, via a link sent by email. No shipping costs apply.
(2) The digital content we offer is protected by copyright. You receive a simple, non-transferable right of private use. Passing on, reproduction, making publicly available and commercial exploitation — including the sale of items made from the pattern, unless expressly permitted in the respective listing — are not allowed.

§ 6 Withdrawal, returns and exchanges
(1) Consumers have a 14-day right of withdrawal. We grant this right regardless of the delivery country; for deliveries within the EU it exists by law, and for deliveries within Switzerland we grant it voluntarily on the same terms.
(2) Details, grounds for exclusion and the model withdrawal form can be found in our return and withdrawal policy, which forms part of these Terms and Conditions.
§ 7 Retention of title and right of retention
(1) The goods remain our property until payment has been made in full.
(2) You may exercise a right of retention only in respect of claims arising from the same contractual relationship.
(3) If you are an entrepreneur, the following applies in addition:
a) We retain title to the goods until all claims arising from the ongoing business relationship have been settled in full. Before title passes, pledging and transfer by way of security are not permitted.
b) You may resell the goods in the ordinary course of business. You hereby assign to us all claims arising from the resale up to the amount of the invoice; we accept this assignment. You remain authorised to collect these claims as long as you meet your payment obligations.
c) If the realisable value of our security exceeds the secured claim by more than 10%, we will release security at your request; the choice of security is ours.
§ 8 Warranty
(1) The statutory provisions on liability for defects apply.
(2) If you are an entrepreneur, the following applies instead:
a) Only our own statements and the product description count as the agreed quality, not other advertising or public statements by third parties.
b) In the event of defects, we will at our discretion either remedy the defect or supply a replacement. If this fails, you may request a reduction in price or withdraw from the contract.
c) The warranty period is one year from delivery. This shortened period does not apply in cases of injury to life, body or health, of intent or gross negligence, of fraudulent concealment of a defect, or where guarantees have been given.
§ 9 Material characteristics and colour variation
(1) Craft materials are subject to natural variation. Differences in colour and irregularities in yarn thickness are typical of the material and constitute neither a reduction in quality nor a production fault.
(2) Colours displayed on screens differ from the original depending on the device. Such deviations do not constitute a defect.
(3) For a consistent result, we recommend buying the yarn for a project from the same dye lot. Your statutory warranty rights remain unaffected.
§ 10 Gift cards, vouchers and discount codes
(1) Gift cards purchased in our shop have no expiry date. The statutory limitation periods apply.
(2) Discount vouchers and promotional codes that we issue free of charge are valid for twelve months from the date of issue, unless a different period is stated.
(3) Payment in cash is excluded. Codes cannot be combined unless expressly stated otherwise.
§ 11 Changes to these Terms and Conditions
We may change these Terms and Conditions for future orders. Contracts already concluded are always governed by the version in force at the time of the order.
§ 12 Choice of law, place of performance and jurisdiction
(1) Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If you are a consumer with your habitual residence in the European Union, this choice of law applies only to the extent that it does not deprive you of the protection afforded by the mandatory provisions of the country in which you reside.
(3) The place of performance is Birmensdorf.
(4) The place of jurisdiction is Birmensdorf where you are an entrepreneur. In relation to consumers, the statutory places of jurisdiction apply; in particular, you may bring proceedings against us at your place of residence, and we may only bring proceedings against you there.
Customer information
Contract language and storage of the contract text
The contract languages are German and English. The language in which you completed the order process is the one that applies. We do not store the contract text in a form that you can retrieve. Before submitting your order, you can save the details using your browser's print function. After we receive your order, we send you the order details and these Terms and Conditions again by email.

Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
